Waiver of Liability

To: Whydah Adventures Ltd., together with its subsidiaries, affiliates, partners, and related entities, and each of their respective directors, officers, staff members, subcontractors, suppliers, agents, guides, volunteers, contractors, representatives, proprietors, insurers, successors, and assigns (collectively, "Whydah Adventures").

Activities

"Activities" refers to every experience, service, and arrangement that Whydah Adventures provides, coordinates, or organises on my behalf, depending on the itinerary I have selected. These may include, without limitation:

• Guided adventure travel and overland tours
• Canyoning and gorge exploration
• Spelunking and cave visits
• Cycling and bicycle touring
• Hang-gliding and glider flights
• Equestrian activities and horse riding
• Hot-air ballooning
• Mountain biking on trails and tracks
• Parasailing and towed aerial flight
• Rock climbing and rope-based ascents
• Abseiling and controlled descent
• Zip-lining and canopy traversal
• Scuba diving and sub-aqua exploration
• Helicopter flights and aerial tours
• White-water rafting and river running
• Jet-boat and high-speed watercraft travel
• Sailing and marine cruising
• Trekking, hiking, and foot travel
• Mountaineering and alpine ascent
• Surfing and board-based wave riding
• Paragliding and free-flight
• All ground, water, and air transport (public and private)

Acknowledgment — Health & Safety

I recognise that the physical demands of the Activities may trigger or worsen pre-existing medical conditions, injuries, or congenital health issues.

I accept that I should consult a qualified medical professional if I know, or have reason to suspect, that my physical condition is incompatible with any Activity.

I understand that approved protective equipment must be worn during certain Activities. I am aware that qualified guides and instructors are available to explain the correct use of any equipment.

Assumption of Risks

I understand that the Activities carry inherent and non-inherent risks, dangers, and hazards, which include but are not restricted to:

• Bodily injury, psychological trauma, and death;
• Journey to isolated locations far from medical facilities or emergency treatment;
• Unpredictable and severe weather events;
• Close contact with wild animals, insects, or marine life;
• Failure or malfunction of equipment, vehicles, or vessels;
• Negligent acts or omissions by fellow participants, guides, or third parties;
• Negligence on the part of Whydah Adventures, including the failure to identify, warn against, or protect me from the risks or dangers of the Activities;
• Impairment caused by the consumption of alcohol or intoxicating substances;
• Impact or collision with vehicles, equipment, infrastructure, or natural features;
• Becoming lost, separated, or disoriented from the group or guides;
• Failure to remain within designated routes, boundaries, or safety zones.

Alcohol and Illegal Substances

If I consume, use, or am under the influence of alcohol or any unlawful drug before or during the Activities, I ASSUME AND ACCEPT ALL RISKS, DANGERS, AND HAZARDS that may arise from that conduct — including the possibility of personal injury, death, property damage, and financial loss — even if such harm is caused in whole or in part by the negligence or fault of Whydah Adventures or any third party. I further agree to indemnify and hold harmless Whydah Adventures from any liability for damage to property or personal injury to any other person resulting from my participation while, during, or after the consumption of alcohol or illegal drugs.

I Am Aware of the Risks, Dangers, and Hazards Associated With the Activities

I am not relying on any oral or written statement, representation, or assurance made by Whydah Adventures about the safety of the Activities, other than what is expressly set out in this Waiver.

I voluntarily and unequivocally accept these risks and the possibility of injury, loss, damage, and death resulting from my participation in the Activities.

Release of Liability, Waiver of Claims, and Indemnity Agreement

In consideration of Whydah Adventures permitting me to take part in the Activities, I agree as follows:

• Should I, or anyone claiming through me (including my heirs, executors, or legal representatives), suffer any loss, damage, expense, injury, or death arising from my participation in the Activities — INCLUDING THOSE CAUSED BY THE RISKS SPECIFICALLY DESCRIBED IN THIS WAIVER — I agree to WAIVE ANY AND ALL CLAIMS I now have or may acquire in the future against Whydah Adventures, and to RELEASE Whydah Adventures from any and all liability for such loss, damage, expense, injury, or death;
• To HOLD HARMLESS AND INDEMNIFY Whydah Adventures from any and all liability for damage to property or personal injury to any third party resulting from my participation in the Activities;
• Any dispute or litigation involving the parties to this Agreement shall be brought exclusively within the courts of the jurisdiction where Whydah Adventures is headquartered, and shall be subject to the sole and exclusive jurisdiction of those courts;
• This Agreement shall be binding upon and inure to the benefit of my heirs, next of kin, executors, administrators, assigns, and legal representatives, in the event of my death or legal incapacity;
• This Agreement, and all rights, duties, and obligations arising between the parties, shall be governed by and interpreted solely in accordance with the laws of that same jurisdiction, to the exclusion of all others.
